According to the Organization for Driving Laws, the factors needed for a driver to be sentenced with DUI vary from state to state. Many states define a drunk driver as someone who does not necessarily need to be driving the car. Basically if they are seen in the car, then they have “physical control” over it. In California, the DUI laws require that the driver be physically driving the car in order for an arrest for driving under the influence to happen.
