Bankruptcy Basics

Bankruptcy is the legal process that a person or entity enters into when they can no longer afford to pay their debts, or are insolvent. Once a bankruptcy petition is filed with the U.S. Bankruptcy Court, the person or entity asserts that they are no longer able to repay debts. There are many different types of bankruptcy that can be filed in the United States. The most common bankruptcy filings are Chapter 7 or Chapter 13, which are named after the corresponding chapters of the Bankruptcy Code. The decision between filing a Chapter 7 or Chapter 13 bankruptcy will largely depend on your financial situation, and your ability to repay creditors.

Chapter 7

A Chapter 7 bankruptcy involves the liquidation of assets to repay creditors. Chapter 7 bankruptcy discharges (eliminates) almost all debts. Debts that survive a Chapter 7 bankruptcy include child support, tax debts, student loans, and debts the court deems appropriate. There are restrictions as to who can qualify for a Chapter 7 bankruptcy. If you have a steady income above a certain level, you will not qualify and a Chapter 13 bankruptcy will be a viable option.

Chapter 13 Bankruptcy

A Chapter 13 bankruptcy is called a reorganization bankruptcy because it involves working with creditors to create a restructured payment plan. This process allows you, in many situations, to keep your property and avoid liquidation of your assets by committing to repay creditors over a span of 3 to 5 years.
